EES didn't record my exit? How to prove you left and ask for a fix
Some travellers report leaving the Schengen area without an electronic exit being recorded, for example when they were waved through. To the system, an entry with no exit looks like a stay that has not ended, and the days keep counting. This guide covers what to keep and what you can ask for. It is general information, not legal advice.
Why it matters
A missing exit can be read as an overstay. Records of overstays can stay on file for years, so it is worth fixing early rather than at your next trip.
Keep proof of every exit
Proof that you left on a given date can come from several places. The more the better:
- A boarding pass or e-ticket showing the date and a departure from a Schengen airport or port.
- A train or ferry ticket for the crossing.
- Accommodation receipts from outside the Schengen area for the following nights.
- A photo of the page of your passport that shows the stamp, if you received one.
- Card payments or other dated records from the other side of the border.
Add them to your log within a few days of leaving, while the details are fresh. The DayCount EU Evidence Vault stores them encrypted on your phone and reminds you.
Your rights over the data
The EES Regulation gives you the right to ask for access to the personal data held about you in the system and to ask for it to be corrected or erased if it is wrong. You can usually make the request to the authorities of a Schengen state, or to the national data-protection supervisory authority. The official EES page explains how to get in touch.
A sensible order of steps
- Check your own record first. Is the exit really missing, or is it a different day? Use your tickets.
- Ask at your next crossing. Show your proof to the officer and ask for the exit record to be checked or corrected.
- Write a short request. State your name and document number, the date and place you left, and attach copies of your proof. Ask for the record to be corrected.
- Keep copies of everything you send and any reply.
- Escalate if needed to the data-protection supervisory authority of the country concerned.
The Evidence Vault can generate a PDF with your entries and exits, the counted-days explanation, your evidence and an editable cover note. It is generated from your own log and is not an official record.
